Terms and Conditions
•Final payment for cakes are to be paid the day before collection. If this is not met Cakes by Estee has the right to refuse the cake.
•Any images or illustrations contained on messages between client and Cakes by Estee are issued solely to provide you with an approximate idea of the cakes they describe and are for inspiration purposes only.
•Any changes to design, flavour or sponge colours needs to be made at least a week in advance. I do not accept any change in the same week the cake is going out.
•Quotations are valid for a period of 3 months from the day of issue.
•No cake is secure until Cake by Estee have received your deposit.
A refund does not apply to any defect in the arising from wilful damage, accident, negligence by you or any third party, if you use the cake in a way I do not recommend, your failure to follow my instructions or any alterations you carry out.
•The cakes are made in an environment where egg, milk, gluten and other allergens are present. We cannot guarantee that any cake is entirely allergen free although we make every effort to ensure that allergies are accommodated.
•Cakes by Estee do not make exact replicas of any cake but I will do my best to make it similar in a Cakes by Estee style. Where colour swatches are provided I will do my best to match as close as I can. Exact colour matches are not guaranteed.
•If flowers are provided by an outside source, I will place them for an additional fee at home. Fresh flowers are not a food product, contain pesticides, insects, dirt, or other contaminants and can be toxic. Due to this Cakes by Estee uses artificial flowers only and are cleaned before placing on cakes.
•From time to time certain materials for cakes may become obsolete. This is totally out of my control; however I will do my best to select replacement products to reflect the original design as closely as possible. I reserve the right to replace items with component parts of equal or better quality without consultation.
•If your cake contains figures made from sugar paste, whilst edible, we do not advise that they be eaten, due to the possible presence of dowels for reinforcement.
•Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.
•Cakes should be stored in the refrigerator, away from direct sunlight and sources of heat. All orders may be collected free of charge from Cakes by Estee. I do not accept responsibility for any damage sustained to the cake once it has left the premises.
•If delivery has been requested I will deliver the cake on the day set out in the order confirmation to the address provided.
•When delivering to a wedding venue, I will contact the venue in advance to arrange a mutually convenient time for delivery.
•The balance must be paid before collection or the cake will not be released.
Balance for Wedding cakes must be paid on the Monday before the event date. This will be clearly stated on the invoice as well.
In the event of a cancellation by yourselves, charges are as follows;
•Any payments previously made are not refundable.
•In the event of a postponement, the payment due remains the same as a cancellation. Subject to availability I will carry the monies paid forward to the new date. Please be aware that we will only do this on one occasion. Any further postponements will be classed as a cancellation.
•In the unlikely event that we need to cancel your order any monies paid will be refunded. Cakes by Estee reserves the right to cancel if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control and Cakes by Estee shall not be liable for any breach of contract resulting from such an event.
•Complaints are very rare and due to the amount of work put into each cake I take them very seriously. Any issues must be bought to my attention with 48 hours on collection or delivery to give fair opportunity to assess the nature of the complaint.
•At least 75% of the cake must be returned within 2 days to ensure we are able to fairly assess the nature of the complaint and determine what course of action we will take. No refund will be given if the cake is not returned or has been eaten.
The maximum refund we offer is the value of the cake. Further compensation is not available. All deposits/booking retainer fees are non-refundable.
•Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.
•Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give me the opportunity to correct them.
